Terms and Conditions
The Applicant understands and agrees that the allocation of an Electronic Reservation Services Provider ("ERSP") numeric code is not part of, and is entirely separate from, the IATA Agency Accreditation process. This application therefore does not constitute an application for IATA Agency Accreditation. The Applicant understands and agrees that acceptance of the application does not entitle him to represent himself as an IATA Agent, or IATA Approved, or IATA Accredited, or as having an IATA Accredited Agent Code, or any other representation which may create the impression of the Applicant being an IATA Agent. The Applicant accordingly agrees not to make any representation, or hold out to the public or the industry that it is an IATA Agent unless and until the Applicant actually secures IATA Accreditation. (Applicants which are IATA Agents see paragraph 8 below.)
The allocation of an ERSP numeric code is subject to payment of a non-refundable application fee of USD200 and an annual listing fee of USD200. The annual listing fee subsequently may be billed to the ERSP numeric code holder on an annual basis. Failure to pay the annual fee by the due date will result in cancellation of the ERSP numeric code.
The Applicant recognises and agrees that IATA has the right to reject the application subject to full refund of the annual listing fee.
A-
The Applicant may notify IATA in writing if the ERSP numeric code is no longer required. Such notification may be given at any time. In such case, there will be no refund of non-refundable applications fee referred to in paragraph 2 above and their registration will automatically expire at the time of notification. The Applicant acknowledges that the ERSP numeric code may in such case be reallocated to another entity. In order to obtain a new ERSP numeric code, a new application including the applicable fees will be required.
B-
The Applicant shall notify IATA in writing of any changes of data provided in this Application and shall keep such data up to date. Further the Applicant shall notify IATA in writing of any change of name and/or address prior to such change. Failure to notify such change may result in the cancellation of the ERSP numeric code.
In the event that the Applicant ceases to be licensed to conduct travel and tourism business under the applicable legislation, the ERSP numeric code will be canceled and there shall be no refund of fees referred to in paragraph 2 above.
The ERSP numeric code is allocated to facilitate identification in electronic reservations processing and related travel information related matters between the Applicant and travel industry principals. The Applicant understands that the unauthorised use of the ERSP numeric code for any other purpose will normally result in the immediate cancellation of the ERSP numeric code and notification thereof to all travel industry principals. The Applicant shall take all due and reasonable precaution to prevent misuse of the ERSP numeric code by third parties and will be responsible for any damage arising from such misuse in case of failure to take appropriate precautions.
The Applicant when reserving air transportation shall follow the procedures outlined in the IATA Passenger Services Conference Manual governing the purchase of air transportation via electronic commerce and shall notify its user that the ticketing of the reservation processed by the ERSP is conducted by an IATA Member or an IATA Accredited Agent when this is the case.
The Applicant expressly recognises that if it is an IATA Accredited Agent, established on the Internet and wishing to provide on-line international air transportation services, any services performed in its capacity as an IATA Accredited Agent shall be performed in accordance with the procedures provided for in its Passenger Sales Agency Agreement and in the Passenger Sales Agency Rules.
In this paragraph, all references to IATA shall include its employees, servants, agents and subcontractors. The Applicant expressly authorises IATA to list the information provided by the Applicant and to disclose such listed information to subscribers of the ERSP list and to such other persons as IATA deems appropriate. IATA will apply all reasonable and due care in processing this application, any notification of cancellation, and any other information provided by the Applicant. However, the Applicant shall not make any claim against IATA, and shall indemnify it against any legal liability for claims and suits, including costs and expenses incidental thereto, in respect of any act or omission of IATA in the processing of this application, the assignment, reproduction, or cancellation of an ERSP numeric code to Applicant, or the processing and representation of information connected with Applicant's ERSP numeric code, unless such acts or omissions are the result of gross negligence or willful misconduct on the part of IATA.
The Applicant expressly recognises that upon acceptance of this form and of this application by IATA, these Terms and Conditions shall become effective and binding.
